A young woman from Forest Hill, London, has had her compensation increased by an appeal court last week after she suffered considerable injury after being struck by a double-decker bus whilst in Crystal Palace in 2005.
Initially Miss Osei-Antwi was awarded £12,000 in damages for her injury paid by the South East London and Kent Bus Company. However her payout was reduced by a third last April when a judge at the Mayor and City of London County Court found her to be partly to blame for the accident. The judge ruled that Miss Osei-Antwi should have been aware of the danger of standing so close to the bus on the day of the accident.
However, following a hearing at the appeal court last week, the judges ruled that Miss Osei-Antwi was not guilty of “contributory negligence” and as a result, her compensation has been increased.
Miss Osei-Antwi who now works as a shop assistant, was standing on the edge of a pedestrian area when the accident occurred back in 2005. A double-decker bus was turning a corner on the street where Miss Osei-Anwi was standing. The front of the bus missed her, but as the rear end attempted to take the turn, it struck Miss Osei-Antwi.
The victim suffered serious injury to her left ankle for which she had to undergo surgery. She also sustained a series of cuts to her left leg.
The bus company will have to pay more than £18,000 to Miss Osei-Antwi following the ruling, and meet all legal costs.
